Why states keep coming after platforms

Federal action against big tech tends to move slowly, tangled in appeals and jurisdictional fights that stretch across years. State attorneys general have figured out they can move faster. New Mexico is not the largest state, and it does not have the biggest legal budget, yet it managed to secure a nine-figure judgment against one of the most valuable companies on the planet.

That should worry Meta’s lawyers more than the dollar amount does. When a single state can extract $942 million over child safety, every other state watching now has a template. The legal theory has been tested. The playbook is written. And child safety is precisely the kind of issue where politicians across the spectrum find it easy to agree and hard to back down.

Meta has spent years insisting it takes youth safety seriously, pointing to parental controls, age checks, and content filters rolled out across Instagram and Facebook. Courtrooms have a way of cutting through that messaging. What matters in front of a judge is not the feature list a company can show off but what its own internal records reveal about what it knew and when it knew it.

The cost of doing business, or a turning point?

There is a comfortable narrative that says fines like this are simply the cost of doing business for platforms of Meta’s scale. Pay the penalty, absorb the news cycle, keep the product running. For a long stretch that narrative held up, because the numbers were small enough to shrug off and the cases rarely stuck.

This one is harder to shrug off. Not because $942 million threatens Meta’s finances, but because the size and direction of the judgment suggest the legal environment is shifting under the company’s feet. A court that adds to a penalty is a court that found the underlying conduct serious enough to punish more heavily. That is a different kind of loss than a negotiated settlement where everyone saves face.

The broader question hanging over Silicon Valley is whether regulators and courts have finally found a pressure point that works. Antitrust cases drag. Privacy fines get appealed into oblivion. Child safety, though, carries a moral weight that changes how juries and judges respond, and it produces the kind of documents that are difficult to explain away.

Meta has options. It can appeal, it can fight the amount, and it can keep arguing that its safety investments are real and improving. What it cannot do is make this case disappear, and it cannot stop other states from noticing what New Mexico just pulled off.

The number to watch now is not $942 million. It is how many other attorneys general file similar suits in the months ahead, and whether the next set of judgments starts to look less like isolated penalties and more like a coordinated reckoning. If that happens, the cost of doing business stops being a rounding error and starts being a strategy problem.
