Jetten condemns US sanctions on ICC and vows to protect the court

Dutch prime minister Rob Jetten has condemned a United States decision to impose sanctions on the International Criminal Court in The Hague, and said the Netherlands would defend the institution “brick by brick”. He spoke after US Secretary of State Marco Rubio announced on Friday that Washington would ban transactions with the court, measures that are due to take effect in April unless diplomacy changes the outcome.

What happened

Jetten responded during a joint press conference in The Hague with Antonio Costa, president of the European Council, DutchNews reports. He called Rubio’s announcement “deeply regrettable” and added: “We’re very much disappointed by this escalation and condemn the announced sanctions.”

The sanctions are not immediate. According to DutchNews, the Trump administration has delayed the start of the measures to allow “time for states parties to demonstrate meaningful progress on diplomatic and legal resolutions that address fundamental US concerns regarding the ICC.” Jetten described the next six months as a “crucial” period.

Rubio argued that the court poses a threat to American service personnel who could face prosecution over their actions during overseas missions, even though the United States is not a member of the ICC. Washington has also attacked the court’s decision to issue arrest warrants for Israeli prime minister Benjamin Netanyahu and former defence minister Yoav Gallant. “We will ban transactions with this rogue court, cutting off their resources and crippling its ability to operate,” Rubio said.

DutchNews explains that the sanctions would cut the court off from any US company or organisation, including providers of financial and technology services. They are the first measures aimed at the institution itself rather than at individual staff. So far the Trump administration has sanctioned 13 judges and officials at the ICC, among them the court’s president, Tomoko Akane, and senior prosecutor Abdoulaye Saye. Those measures bar them from travelling to the US and from using banking services.

The timing drew attention. The announcement came hours after South African jurist Navi Pillay, who has served as a judge at both the ICC and the International Court of Justice in The Hague, was awarded the Nobel Peace Prize.

Why it matters if you live in the Netherlands

The ICC is based in The Hague, and the Netherlands is its host country. That gives the Dutch government a particular responsibility here, and Jetten made clear he sees it that way. “We will do everything to protect the ICC,” he said, according to DutchNews.

The question most relevant to people working in the Netherlands is how far the sanctions could reach. A ban that cuts the court off from American financial and technology providers would affect the services any modern institution relies on to function day to day. Anyone who works at the court, or for an organisation that supplies or works with it, has good reason to follow how the dispute develops.

Jetten would not say whether the Netherlands would ask the European Union to activate its blocking statute. DutchNews explains that this legal tool would order EU-based businesses not to comply with the US sanctions. If it were used, companies operating in the Netherlands and the rest of the EU could find themselves caught between American restrictions and a European legal obligation to ignore them. For now, this is only a possibility the prime minister declined to rule in or out, not a decision.

The story also matters for The Hague’s standing as a centre of international law, a role that brings many international residents to the city. Pillay’s Nobel Peace Prize, awarded to someone who has served on both of The Hague’s leading international courts, came on the same day as the most serious US move yet against one of them.

Voters may also want to note the political setting. DutchNews refers to a Dutch general election taking place this month, so how the Netherlands handles the defence of the court is unfolding during an election period.

What to watch next

The six-month window is the key period. Jetten called for “open dialogue” with the United States during that time “to prevent the sanctions being implemented in April”. He was also frank about the chances of success: “At the same time we are preparing for a more difficult situation.”

Three developments are worth following. The first is whether the states that belong to the ICC can show Washington the “meaningful progress” the US administration has demanded, and what that might involve. The second is whether the Netherlands, as host country, asks the European Union to activate the blocking statute, a step that would have direct consequences for businesses based in the EU. The third is whether the US adds to the 13 judges and officials it has already sanctioned before the measures against the institution take effect.

Jetten’s joint appearance with Costa suggests the Dutch government wants this treated as a European issue rather than a purely national one. How firmly the EU as a whole backs the court over the coming months will shape what happens in April.
